What is the penalty for an entity that does not display the posters as required under Act 62?

If the department determines that an entity required to post notices under Act 62 has failed to comply with the notice requirements of Act 62, the department shall notify the entity that it is in violation of the Act and provide the entity with 48 hours to come into compliance. Subsequent violations in a 1 year period, after being notified of the requirements, may result in fines.

  • If an entity required to post notices under Act 62 is notified a second time of failure to comply with the requirements of the Act, the entity may be fined not more than $250.00;

  • If the same entity is notified a third time of a failure to comply with the requirements of the Act, within 1 year of the previous 2 notifications, the entity may be fined not more than $500.00.

The goal of the Wage and Hour Division is to achieve full voluntary compliance by providing the posters without cost to covered entities.
