Subdivision, Condominium and Land Division Construction (On-Site Water Supply and Sewage Disposal)

Projects involving a subdivision or condominium development utilizing individual, on-site, subsurface disposal systems or individual wells are required to submit preliminary plat drawings or condominium subdivision plans for review and approval by local health departments or in some cases by the MDEQ.

MDEQ Administrative Rules for Land Divisions and Subdivisions

Subdivisions, condominium projects, and land divisions less than one acre intended to be served by individual, on-site, sewage systems or individual wells.

Site suitability approval in accord with the requirements of MDEQ administrative rules must be obtained from the local health department having jurisdiction for proposed subdivisions, condominium projects, and land divisions less than one acre if they are not to be served by public sewer.

Three copies of the subdivision preliminary plat drawing or condominium must be submitted to the local health department by the owner or designated representative. In addition, a completed Site Report form which confirms site suitability must be submitted to the local health department by the project engineer or surveyor. For land divisions less than one acre, local health department approval for the suitability for on-site systems must be available prior to the governing body issuing a building permit.

The engineer or surveyor for the proprietor is responsible for gathering supporting information documenting site suitability including soils and water well quantity, quality, and protection. This information is summarized in the Site Report form and submitted along with the proposed subdivision preliminary plat drawing or condominium subdivision plan to the local health department having jurisdiction. Approvals are granted where supporting information confirms that the provisions of the rules are met.

The public typically learns about proposed subdivision or condominium development, or land division through newspaper notices posted by the local municipality under zoning and land use ordinances, and this venue provides the best opportunity for public input. The public may also offer comments to the MDEQ regarding these proposals although there is no legislative mandate establishing a procedure for public comments.
