Oil & Gas Well Applications to Change Well Status

The Oil, Gas, & Minerals Division (OGMD), within the Michigan Department of Environment, Great Lakes, and Energy (EGLE), has responsibility for approving applications to change well status under Part 615, Supervisor of Wells (formerly Public Act 61 of 1939, as amended), of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA). The purpose of this approval is to prevent surface or underground waste and to protect correlative rights.

A. NAME OF PERMIT OR APPROVAL:

D. SUMMARY OF PERMIT/APPROVAL PROCESS:

 1.  Applicability (activities that require the permit)

A permittee of a well who desires to change the status of a well by an operation, except additional acid or other stimulation treatment, shall file an application to change well status with the Supervisor of Wells.

 2.  Pre-Application Requirements

  • Permit must be approved before rework operations commence

  • Application to Change Well Status forms (EQP 7200-6) are available from the OGMD

     3.  Application Submission Requirements

    The application identifies the proposed operation and sets forth a plan for protecting all oil, gas, brine, or fresh water strata which has been penetrated

     4.  Procedures and Time-Frame for Obtaining Permit or Approval

  • Submit an original and three copies to the OGMD district office

  • The area geologist reviews the application and determines if it is acceptable and/or if it requires additional conditions

     5.  Operational Requirements

    Applicant must comply with all applicable rules, regulations, stipulations set forth in the application, and permit conditions.

     7.  Appeal Process

  • Public hearing before the Supervisor of Wells

  • Appeal to Circuit Court

     8.  Public Input Opportunities

    This is considered a modification of an existing permit (see Section 5.7.2.) The decision maker for this approval is the district supervisor of Geological Programs of OGMD. Applications to Change Well Status for individual wells may be found on the oil and gas well database at: http://www.deq.state.mi.us/geowebface/. In addition, individuals may subscribe to the oils and gas permit list by contacting the Permits and Bonding Unit of OGMD.
