Unanticipated School Closure Waivers

1. COVID-19: Child Nutrition Response #1; Nationwide Waiver to Allow Meal Service Time Flexibility in the Child Nutirition Programs

  • This waiver applies to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Services Program.

  • Waives mealtime requirements to support streamlined access to meals including providing more than 1 meal during pick up or delivery service.

  • Michigan will participate in this waiver.

  • There are no further requirements from sponsors at this time.

  • This waiver is effective immediately and will remain in effect until June 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

 

2. COVID-19: Child Nutrition Response #2; Nationwide Waiver to Allow Non-congregate Feeding in the Child Nutrition Programs

  • This waiver applies to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Service Program.

  • Allows for meal service using grab and go and meal delivery options.

  • Michigan will participate in this waiver.

  • There are no further requirements from sponsors at this time.

  • This waiver is effective immediately and will remain in effect until June 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

 

3. COVID-19: Child Nutrition Response #3; Nationwide Waiver of the Activity Requirement in Afterschool Care Child Nutrition Programs

  • This waiver applies to afterschool snacks in the National School Lunch Program and at-risk afterschool meals and snacks in the Child and Adult Care Food Program.

  • Waives the requirement for schools and at-risk afterschool care centers to serve meals and snacks in a structured and supervised environment, with an education or enrichment activity.

  • Michigan will participate in this waiver.

  • There are no further requirements from sponsors at this time.

  • This waiver is effective immediately and will remain in effect until June 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

 

4. COVID-19: Child Nutrition Response #4; Nationwide Waiver to Allow Meal Pattern Flexibility in the Child Nutrition Programs

  • This waiver applies to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Services Program.

  • This waives the requirements to serve meals that meet the meal pattern requirements.

  • Michigan will participate in this waiver.

  • Sponsors are approved on a case-by-case basis.

  • This waiver is effective immediately and will remain in effect until April 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

  • As a reminder, Federal procurement regulations at 2 CFR 200.320(f) allow procurement by noncompetitive proposals when there is a public emergency.

 

5. COVID-19: Child Nutrition Response #5; Nationwide waiver to Allow Parents and Guardians to Pick Up Meals for Children

  • This waiver applies to the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, and Summer Food Services Program.

  • This allows program operators to distribute meals to a parent or guardian to take home to their children.  Program integrity must be maintained. Program operators must have processes in place to ensure:

    • Meals are distributed only to parents or guardians of eligible children.

    • Duplicate meals are not distributed to any child.

  • Michigan will participate in this waiver.

6. COVID-19: Child Nutrition Response #6; Nationwide Waiver of Community Eligibility Provision (CEP) Deadlines in the National School Lunch and School Breakfast Programs

  • This waiver applies to the National School Lunch Program and School Breakfast Program.

  • Extends the School Year 2020-21 CEP application deadline until August 31, 2020, or the first day of school, whichever comes first.

  • Michigan will participate in this waiver.

7. COVID-19: Child Nutrition Response #7; Nationwide Waiver of Monitoring Requirements for Sponsors in the Child and Adult Care Food Program

  • This waiver applies to the Child and Adult Care Food Program sponsoring organizations.

  • Child and Adult Care Food Program sponsoring organizations may:

    • Conduct two reviews of their facilities,

    • Complete one of the two reviews, unannounced,

    • Waive completion of a meal observation during the unannounced review,

    • Waive the no more than 6 months may elapse between reviews requirement, and

    • Conduct a new facility review as a desk audit

  • Michigan will participate in this waiver.

8. COVID-19: Child Nutrition Response #8; Nationwide Waiver of Onsite Monitoring Requirements for State Agencies in Child Adult Care Food Program

  • This waiver applies to the Child and Adult Care Food Program.

  • Allows MDE to continue monitoring activities with sponsoring organizations via off-site desk audits.

  • Michigan will participate in this waiver.

  • There are no further requirements from sponsors at this time.

  • This waiver is effective immediately and will remain in effect until June 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

 

9. COVID-19: Child Nutrition Response #9; Nationwide Waiver of Onsite Monitoring Requirements for State Agencies in School Meal Programs

  • This waiver applies to all the School Meal Programs.

  • Allows MDE to postpone or delay Administrative Reviews until School Year 2020-2021.

  • Michigan will participate in this waiver.

10. COVID-19: Child Nutrition Response #10; Nationwide Waiver of Onsite Monitoring Requirements for Sponsoring Agencies in the Summer Food Service Program

  • This waiver applies to the Summer Food Service Program.

  • Allows for Summer Food Service Program sponsoring organizations to continue monitoring activities of Program operations offsite (e.g. through a desk audit).

  • Michigan will participate in this waiver.

11. COVID-19: Child Nutrition Response #11; Nationwide Waiver of Onsite Monitoring Requirements for State Agencies in Summer Food Service Program

  • This waiver applies to the Summer Food Service Program.

  • Allows MDE monitoring of Summer Food Service Program sponsors and sites to be conducted offsite (e.g. through a desk audit).

  • Michigan will participate in this waiver.

12. COVID-19: Child Nutrition Response #12; Nationwide Waiver of 60 Day Reporting Requirements for January and February 2020

  • This waiver applies to the National School Lunch Program (NSLP), the School Breakfast Program (SBP), the Special Milk Program (SMP), the Child and Adult Food Care Program (CACFP), and the Summer Food Service Program (SFSP).

  • This waiver applies to claims covering operations in the months of January and February 2020. Deadlines for these two claim months are extended for 30 calendar days from their original required date of submission.

  • Michigan will participate in this waiver.

  • MDE encourages Child Nutrition Program sponsors to still meet their respective January and February 2020 Reimbursement Claim Deadlines.

  • This waiver is effective immediately.

 

13.  COVID-19: Child Nutrition Response #13; Nationwide Waiver to Allow Meal Pattern Flexibility in the Child Nutrition Programs - EXTENSION

  • This waiver applies to the National School Lunch Program (NSLP), the School Breakfast Program (SBP), the Child and Adult Food Care Program (CACFP), and the Summer Food Service Program (SFSP)

  • This extension waives the requirements to serve meals that meet the meal pattern requirements.

  • Michigan will participate in this waiver.

  • Sponsors are approved on a case-by-case basis.

  • This waiver is effective immediately and will remain in effect until 5/31/2020, or until expiration of the federally declared public health emergency, whichever is earlier.

 

14.  COVID-19: Child Nutrition Response #14; Nationwide Waiver to Allow Area Eligibility for Closed Enrolled Sites in the Summer Food Service Program and the National School Lunch Program Seamless Summer Option

  • This waiver applies to the National School Lunch Program (NSLP) and Summer Food Service Program Seamless Summer Option
  • This waiver allows closed enrolled sites in the Seamless Summer Option to determine site eligibility through area eligibility without collecting income eligibility applicaitions.
  • Michigan will participate in this waiver.
  • There are no futher requirements from sponsors at this time.
  • This waiver is effective immediately and will remain in effect until September 30, 2020.

 

15.  COVID-19: Child Nutrition Response #15; Nationwide Waiver to Waive First Week Site Visits in the Summer Food Service Program

  • This waiver applies to the Summer Food Service Program (SFSP)

  • This waives the requirement that Summer Food Service Program sponsors are required to visit each of their sites at least once during the first week of operation.

  • Michigan will participate in this waiver.

  • There are no further requirements from sponsors at this time.

  • This waiver is effective immediately and will remain in effect until September 30, 2020.

 

16.  COVID-19: Child Nutrition Response #16; Nationwide Waiver to Allow Offer Versus Serve Flexibilities in the Summer Food Service Program

  • This waiver applies to the Summer Food Service Program (SFSP)
  • This waives the requirements that limit the use of Offer Versus Serve (OVS) to School Food Authorities and require sponsors to apply OVS under the rule followed for the National School Lunch Program.
  • Michigan will participate in this waiver.
  • Sponsors must follow SFSP OVS meal service parameters as outlined in waiver notice.
  • This waiver is effective immediately and will remain in effect until September 30, 2020.

 

17.  COVID-19: Child Nutrition Response #17; Nationwide Waiver of Meal Service Time Restrictions in the Summer Food Service Program and the National School Lunch Program Seamless Summer Option

  • This waiver applies to the National School Lunch Program (NSLP) and Summer Food Service Program Seamless Summer Option.
  • This waives the meal service time requirements allowing meals served outside of the standard meal times.
  • Michigan will participate in this wavier.
  • There are no further requirements from sponsors at this time.
  • This waiver is effective immediately and will remain in effect until September 30, 2020.

 

18.  COVID-19: Child Nutrition Response #18; Nationwide Wavier of Local School Wellness Policy Triennial Assessment in the National School Lunch and School Breakfast Programs

  • This waiver applies to the National School Lunch Program and School Breakfast Program.

  • Postpones the due date of the triennial assessment to June 30, 2021. Sponsors prepared to complete their assessment by the original due date of June 30, 2020, should do so.

  • Michigan will participate in this waiver.

  • Sponsors wishing to accept this new deadline, must inform the State agency by June 15, 2020. Please complete the Local Wellness Policy Triennial Assessment Waiver survey to accept this waiver.

  • This waiver is effective immediately.

 

19.  COVID-19: Child Nutrition Response #19; Nationwide Waiver of Food Service Management Contract Duration in the National School Lunch Program and Summer Food

  • This waiver applies to the National School Lunch Program (NSLP) and Summer Food Service Program (SFSP).
  • Waives the food service management company (FSMC) contracts duration requirements. FSMC contracts that may expire by or around June 30, 2020, may be extended through June 30, 2021.
  • Michigan will participate in this wavier.
  • There are no further requirements from sponsors at this time.
  • This waiver is effective immediately and will remain in effect until September 30, 2020.

 

20.  COVID-19: Child Nutrition Response #20; Nationwide Waiver of Annual Review Requirements for State Agencies in the Child and Adult Care Food Program

  • This waiver applies to the Child and Adult Care Food Program (CACFP).

  • Waives State Agency CACFP monitoring requirements for conducting one scheduled visit, in no less than three-year intervals, due to safety concerns and closure of many CACFP institutions during the public health emergency.

  • Waives the State Agency requirement to annually review at least 33.3 percent of all CACFP institutions with at least 15 percent unannounced due to safety concerns and closure of many CACFP institutions during the public health emergency.

  • MDE will conduct desk audits, as applicable, for CACFP Institutions through September 20, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.

  • Michigan will participate in this waiver.

  • This waiver is effectively immediately and will remain in effect until September 30, 2020, or until expiration of the federally declared public health emergency, whichever is earlier.
