MPSC Directs Wisconsin Electric Power Company to Switch Customers Immediately Who Elected Service from Integrys Energy Services, Inc.

September 24, 2013 –The Michigan Public Service Commission (MPSC) today directed Wisconsin Electric Power Company (WEPCo) to switch customers who elected service from Integrys Energy Services, Inc., an alternative electric supplier, immediately.

Today’s order comes as a result of a complaint filed on June 26 by Integrys Energy Services, Inc. that alleged delays in allowing customer migration to retail access service, also known as electric choice.

In its complaint, Integrys alleged that WEPCo was in violation of the RAS-1 tariff by not scheduling the switch dates for two customers eight business days after validation of the switch request.

In today’s order, the MPSC noted that tariffs bind the filing party “with the force of law” and to the extent that the language of any agreements conflicts, the tariffs control. Therefore, the Commission found that WEPCo shall arrange for the two customers to switch to choice service immediately.

The MPSC is an agency within the Department of Licensing and Regulatory Affairs.
