Payroll Companies Closing: Protect Yourself

When a payroll company’s abrupt closure impacts Michigan employees or employers, complaints may be directed to the Attorney General’s Payroll Fraud Enforcement Unit: 833-221-1099.

Additional steps to take include:

Employees:

  • Notify your bank or credit union in writing that withdrawals by the closed payroll company are not authorized.
  • Gather all paystubs and other employment data available.
  • If money is incorrectly withdrawn from your account, immediately file an “unauthorized automatic clearing house” (ACH) transaction complaint with your bank or credit union.
  • Get written confirmation from your employer that payroll taxes have been paid.

Employers:

  • Notify your bank or credit union in writing that withdrawals from the closed payroll company are not authorized.
  • Communicate with your employees and determine precisely how they have been impacted.
  • If money is incorrectly withdrawn from a business account, file an “unauthorized ACH” transaction complaint with your bank or credit union.
  • Gather all data available for your account, confirm whether employee payroll taxes have been paid, and monitor your account for any improper transactions.
  • Get legal advice from a private attorney.
